We may find that the third-part role drops out, but let’s leave it in for now.
User Motivation
This is not part of the Cohn formulation, but it is a critical part of a lawyer’s analysis. It relates in large part to the “game theory” aspects of contract negotiation, so we should include reference to it. Rarely will it be explicitly stated, but partner motivation exploration is always a useful exercise, rather than assume we know the answer to “Why did they choose our company?”.
